Interested parties may be asked to provide ‎information and documentation demonstrating that they are bidders with the financial and legal ‎ability to close a transaction for the purchase of the Collateral (“Qualified Bidders”). The sale of the Collateral shall be conducted pursuant to all terms and conditions announced prior to the commencement of the public sale, specifically including but not limited to: buyer ‎is responsible for (a) obtaining possession of the Collateral, (b) ‎obtaining any necessary approvals from the seller, (c) any existing tenancy and prompt payment of the ‎purchase price according to the terms issued by Seller. The sale shall be “as is, where is and with all faults” ‎and subject to any prior liens. No bid shall be accepted with any contingency of any nature. A deposit of ‎fifty percent (50%) of the bid amount must be paid at Sale, in the form of a certified check payable to Secured Party. Seller nor the Auctioneer makes no warranty or representation in connection with the sale, except that the Seller has a ‎security interest in the Collateral and that the transfer is made free and clear of its security interest. There is ‎no warranty relating to title, possession, quiet enjoyment, merchantability or fitness, and each are expressly ‎disclaimed.
